If you receive Social Security Disability, your spouse may qualify for benefits on your record — generally if they are 62 or older, or caring for your child under 16 or a disabled child of any age. Divorced spouses may also qualify. Our Cape Coral, FL attorneys handle these claims. Call 1-800-572-3753 or see family benefits.

When Does a Spouse Qualify?

Two main routes exist, and they suit very different households.

Age 62 or older. A spouse who has reached 62 may claim on your record. Claiming before full retirement age permanently reduces the amount, so timing is a real decision rather than a formality.

Caring for a child. A spouse of any age may qualify if they are caring for your child under 16, or a child of any age who was disabled before 22. This route has no age requirement — it exists because caring for that child limits their ability to work.

The Child-in-Care Gap

The second route ends when the youngest child turns 16, even though the practical caregiving rarely does. Spouses frequently lose the benefit and only discover why afterwards.

If your child has a disability, the exception matters enormously — benefits can continue where the child was disabled before 22. Documenting that onset date properly is worth doing early rather than at the point the payment stops.

Divorced Spouses

A former spouse may claim on your record if the marriage lasted at least 10 years, they are unmarried, and they are 62 or older. Their claim does not reduce your benefit or your current spouse’s, and you are not notified.

Many divorced people never learn they are eligible. If a long marriage ended and your former spouse is disabled or approaching 62, it is worth checking.

How Much Does a Spouse Receive?

A spousal benefit is generally up to 50% of your full benefit amount, reduced if claimed before full retirement age.

All dependent benefits together are also subject to the family maximum — usually between 150% and 180% of your benefit. Where the total exceeds it, each dependent’s share reduces proportionally, though your own payment is unaffected.

Spousal Benefits and Your Own Record

A spouse with their own work history can generally claim whichever benefit is higher, not both. Where their own record produces a smaller payment, Social Security may top it up to the spousal amount.

Working out which to claim, and when, is worth doing before filing rather than after. The decision is often permanent.
