Service members disabled while on active duty on or after October 1, 2001 may receive expedited Social Security Disability processing under the Wounded Warriors program. Benefits run alongside VA compensation, not instead of it. Our Cape Coral, FL attorneys handle these claims. Call 1-800-572-3753.
Social Security operates a specific process for military service members who became disabled while on active duty on or after October 1, 2001. Claims are moved ahead of the standard queue.
Where the disability arose matters less than when. The injury or illness does not need to have occurred during combat, or even during deployment — what counts is that it happened while on active duty in that period.
This is the point most often misunderstood, and it costs veterans money.
A 100% VA rating does not automatically approve a Social Security claim. The two agencies apply different standards. Social Security asks only whether you can perform substantial work; the VA rates severity of service-connected conditions.
The reverse is also true — a modest VA rating does not prevent Social Security approval. Both should be pursued, and one can be approved while the other is denied.

It moves your claim up the queue. It does not lower the medical standard.
You must still show a condition preventing substantial work, expected to last at least 12 months or result in death, supported by proper documentation. Faster processing on an under-evidenced claim simply produces a faster denial.
Receiving military pay while hospitalized or on limited duty does not automatically prevent Social Security eligibility. What matters is whether you are performing substantial work.
Service members are sometimes told to wait until discharge before applying. That is often wrong, and waiting can cost months of back-pay.
Military treatment records, line-of-duty determinations, medical evaluation and physical evaluation board findings, VA rating decisions and DD-214 all support a claim.
We gather these alongside civilian medical records, since Social Security judges weigh both and military records alone rarely address the vocational question directly.
Approval on a service member’s record can also open benefits for a spouse, minor children or an adult child disabled before 22. Those claims are separate from anything the VA pays, and they are frequently missed.
We review the whole household rather than the single claim, because the additional benefits are often worth more than clients expect.
